What Happens After Arrest in Idaho

Understanding the process helps you take the right steps quickly.

      📄

      1. Find Out the Bail Amount

The booking record shows the bail amount set. For most misdemeanors, bail is set automatically from the county bail schedule immediately after booking. For felonies, bail is formally set at arraignment within 48 hours. A bail bondsman posts bail for roughly 10% of the total amount.

      📄

      2. Note the Court Date

Arraignment must occur within 48 hours of arrest in Idaho. At arraignment, formal charges are read and bail is confirmed or modified. Having an attorney present at arraignment can make a significant difference in bail terms and case strategy.

      3. Contact a Defense Attorney

Early legal representation matters. An attorney can intervene before charges are formally filed, argue for reduced bail at arraignment, and begin building a defense while evidence is fresh. Do not wait until after arraignment to seek counsel.

      📞

      4. Set Up Communication

Inmates make outbound calls through the jail phone system. You must set up a prepaid account with the jail's phone vendor before receiving a call. Contact the jail directly to confirm their phone system provider and visitation hours.

Understanding Idaho's Jail and Prison System

Idaho has two separate incarceration systems that are often confused. County jails hold people who have been recently arrested and are awaiting trial, people serving sentences under one year, and those awaiting transfer. There are 44 county jails, one in each county, operated by the county sheriff.

The Idaho Department of Correction (IDOC) operates state prisons that hold people convicted of felonies serving longer sentences. If you cannot find someone in county jail records, they may have already been transferred to IDOC custody - search the IDOC offender database separately.

Federal facilities in Idaho hold people convicted of federal crimes under the Bureau of Prisons. Major federal facilities in Idaho include FCI Sheridan (Oregon) and FDC SeaTac. These are not searchable through county systems.

      Can't Find Them?

If you cannot locate someone in county jail records, they may be in a different county, still being processed (allow 2-4 hours), transferred to IDOC state prison, or in a federal facility. Call our free line and we search all systems at once.

For state prison inmates, the Idaho Department of Correction (IDOC) maintains an online offender search at cor.idaho.gov. However, county jail inmates are not included in that database. Each of Idaho's 44 counties maintains its own separate system. This website links to all 44 county sheriff inmate rosters, making it the most comprehensive starting point for any Idaho county jail search.

Under Idaho law, a person arrested without a warrant must be brought before a magistrate within 48 hours for arraignment, excluding weekends and holidays.
